What If The Airline Denies your Claim?

If the airline rejects your claim or ignores you, it doesn’t necessarily mean your flight compensation claim is over. Many passengers come to Flight Delays after initially being rejected by the airline when approached directly. Some airlines often provide smoke screen defences to avoid paying valid claims. Our experience, and that of our experienced panel solicitors combined with specialist verification methods, means our clients find out quickly if they are likely to have a valid claim.

Some airlines would prefer not to have to pay out flight delay compensation to their passengers. Factors such as administration time, drop in profits and loss of reputation all contribute to a lack of will from many airlines to address these issues. They may reject your claim if the airline can prove the flight delay was unavoidable as a result of extraordinary circumstances. Other factors such as industrial strike action and weather conditions can favour the airline in claims for compensation.

Since the introduction of EU regulation EC 261/04 back in 2004, it has been deemed that compensation must be paid out to delayed flight passengers under certain circumstances. If the flight has been delayed and the airline fails to provide evidence that an extraordinary circumstance caused it, then they must compensate all passengers who have been affected.
